Terms of Use

What Near You is

Near You is a marketplace platform run by Niamee Investments SMC Ltd [registration details to be added]. We connect people who want to sell, buy or ask for things. We are not the seller or the buyer, we do not own or inspect what is listed, and we do not guarantee that a listing is accurate or that a person will do what they promise. Deal with people carefully and meet in safe, public places.

Your account

• You must be 18 or over and give true details.
• Keep your password and codes private. You are responsible for what happens on your account.
• One person, one account. Do not sell or share an account.

What you may and may not list

You may list lawful goods and services that you have the right to sell. You must not list anything illegal, stolen, counterfeit, dangerous or misleading, or anything on our list of prohibited and restricted items [link to that policy, to be published]. Some categories, such as vehicles and property, are checked by a moderator before they appear.

Keep your listings current. Mark an item sold or paused as soon as it is no longer available, and answer our reminders. Listings that are not refreshed expire and may be removed.

How you must behave

• Do not harass, threaten or cheat anyone, or send spam.
• Do not post other people's personal details or pictures without permission.
• Do not try to break, overload or get around the security of the service, or collect data from it automatically.

Our right to act

We may review, hide, remove or refuse a listing, and suspend or close an account, if we believe these terms or the law are broken, or to protect people. Where we can, we will tell you why and let you appeal. We may pass information to the police where the law requires or allows it.

Delivery, payments and fees

At the moment, Near You does not take payments, hold money or run deliveries. Any payment is between you and the other person. If we add delivery, payment holding or fees, we will publish separate terms for them first, and a licensed payment provider will hold any money, not us. [Counsel to confirm before launch.]

Your content

You keep ownership of what you post. You give us permission to show, store, resize and share it as needed to run Near You. You promise you have the right to post it.

Our responsibility

We work to keep the service available, but we do not promise it will never be interrupted or error free. To the extent the law allows, we are not responsible for deals between users, for the quality, safety or legality of items listed, or for losses that come from your use of the service. Nothing here limits any right you have by law that cannot be limited. [Counsel to settle the exact wording of this section.]

Ending your use

You can stop using Near You and ask us to delete your account at any time, as explained in our Privacy Policy.

Changes and law

We may update these terms and will tell you about changes that matter before they take effect. Continuing to use the service after that means you accept them. These terms are governed by the laws of Uganda, and the courts of Uganda can hear disputes, unless the law of your country gives you other rights. [Counsel to confirm.]
